Eşdeğer Parça Tanımı ve Genel Şartları
T.C. Başbakanlık Hazine Müsteşarlığı’nın 2015/2 sayılı
Motorlu Araç Sigortalarında Eşdeğer Parça Belgelenmesi
Esaslarına İlişkin Genelge ile Türkiye’de ‘Eşdeğer Parça’
dönemi başlamıştır. Otomotiv yan sanayisini desteklemek
amacıyla başlatılan, (muadil) eşdeğer parça kullanımıyla
ilgili genelge 1 Haziran’da yürürlüğe girmiştir.
2015/2 sayılı Genelge’nin 1. Maddesinde;
“Eşdeğer parça, bir aracın montajında kullanılan esas-
orijinal parçaların değiştirilmesi amacıyla üretilen, ilgili
yasal mevzuat (yönetmelik, standard, teknik düzenleme)
çerçevesinde belirlenen deney, muayene metotlarına göre
orijinal parçayla(kütle, boyut, malzeme ve işlevsellik vb.)
kıyaslanarak tespit edilen kriterlere uygunluğu, akredite
bir kuruluş tarafından belgelendirilmiş parçadır” şeklinde
tanımlanmıştır.
Aynı maddenin devamında sigorta şirketleri motorlu araç
sigortaları kapsamında tedarik ettikleri eşdeğer parçanın bu
niteliği taşımamasından hak sahibine karşı sorumludurlar.
Motorlu araç sigortalarına ilişkin mevzuatta eşdeğer parça
kullanılmasına izin verilen durumlarda bu genelge ile
belirlenen usul ve esaslara göre belgelenmiş eşdeğer parça
kullanılması zorunludur” denmektedir.
7. Madde’de ise, “
Sigorta şirketleri bu genelge esaslarına
göre eşdeğer parçaları belgelendirilmiş ve bu genelge
uyarınca eşdeğer parça takibi için gerekli altyapıyı kurmuş

Spare Parts
With the communiqué series 2015/2 issued by the
Undersecretary of the Treasury of the Prime Ministry
of Turkish Republic, regarding “The Principles for
Documentation of Equivalent Spare Parts for Motor Vehicle
Insurances”, a new ‘Spare Parts’ era started in Turkey. The
communiqué regarding spare part use that was issued in
order to support automotive side industry, took effect on 1
June 2015.
The first article of the communiqué series 2015/2 states as
follows;
“Spare part is the part that is manufactured for the purpose
of replacing the original part of the motor vehicle, the
compatibility of which is verified and documented by an
accredited organization via test and inspection methods set
forth in the relevant legislation (bylaw, standard, technical
specification) and by comparing the spare part with the
original part (based on criteria such as mass, dimensions,
material and functionality etc)”.
As per the same article, insurance companies are liable
towards beneficiaries when the spare part provided does
not meet the required specifications. In cases where the
legislation for motor vehicles allows the use of equivalent
spare parts, it is mandatory to use equivalent spare parts
that are documented in accordance with the principles and
rules set forth in this communiqué.
